1. Introduction

Welcome to StoryKid (storykid.ai), a platform for creating personalized, AI-generated children's storybooks. StoryKid is operated by Galgomedia LLC, a company registered in the State of New York, United States.

By accessing or using our website and services, you agree to be bound by these Terms of Use. If you do not agree, please do not use StoryKid.

2. Eligibility & Parental Consent

You must be at least 13 years of age to create an account and use StoryKid. If you are under 18, you must have the consent of a parent or legal guardian to use our services.

By creating an account, you represent that you are at least 13 years old and, if a minor, that your parent or guardian has reviewed and agreed to these Terms on your behalf.

3. Account & Orders

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information when creating an account and placing orders.

4. Content Ownership

Your content. You retain ownership of the personal information, photos, and story preferences you provide to StoryKid (collectively, "Your Inputs").

Generated content. The stories, illustrations, and compiled books produced by our AI-powered platform ("Generated Content") are jointly owned. You receive a perpetual, non-exclusive, personal license to use, share, and print your Generated Content for personal, non-commercial purposes. StoryKid retains the right to use Generated Content for platform improvement, marketing, and service delivery.

You may not resell, redistribute, or sublicense Generated Content as standalone products (e.g., you may not sell the illustrations separately).

5. AI-Generated Content Disclaimer

StoryKid uses artificial intelligence to generate stories and illustrations. While we design our AI systems to produce age-appropriate, high-quality content, we cannot guarantee that every output will be free of errors, inaccuracies, or unexpected results.

StoryKid is not responsible for the specific content produced by AI models. You acknowledge that AI-generated text and images may occasionally contain imperfections. We encourage you to review your story before approving it for printing.

You agree that you will not use StoryKid to generate content that infringes on third-party intellectual property rights, and you are responsible for ensuring that any photos or inputs you provide comply with applicable copyright and privacy laws.

6. Refund Policy

Due to the personalized, on-demand nature of our products, all sales are final and non-refundable. Each book is custom-created based on your unique inputs and cannot be resold or restocked.

If your order arrives damaged or with a significant printing defect, please contact us at hello@storykid.ai within 14 days of delivery. We will assess the issue and, at our discretion, arrange a replacement.

7. Third-Party Services

StoryKid relies on trusted third-party providers to deliver our services:

• Anthropic (Claude) — AI story generation
• Replicate (FLUX) — AI illustration generation
• Lulu Direct — Book printing and fulfillment
• Stripe — Payment processing
• Resend — Transactional email delivery

Your use of StoryKid is also subject to the terms and policies of these providers. We select our partners carefully but are not responsible for their independent actions or service interruptions.

8. Prohibited Conduct

You agree not to:

• Use StoryKid for any unlawful purpose
• Upload content that is obscene, defamatory, or infringes on others' rights
• Attempt to reverse-engineer, scrape, or exploit our AI systems
• Use automated tools to access StoryKid in a manner that exceeds reasonable use
• Impersonate another person or misrepresent your identity

9. Limitation of Liability

To the maximum extent permitted by law, StoryKid and Galgomedia LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including but not limited to loss of data, revenue, or profits.

Our total liability for any claim arising from or related to these Terms shall not exceed the amount you paid to StoryKid in the 12 months preceding the claim.

10. Dispute Resolution & Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of StoryKid shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

Arbitration shall take place in New York, New York, or remotely at the discretion of the arbitrator. You agree that any arbitration shall be conducted on an individual basis and not as a class action or collective proceeding.

You retain the right to bring claims in small claims court if they qualify.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict-of-law principles.

12. Modifications

We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice on our website. Your continued use of StoryKid after changes take effect constitutes acceptance of the updated Terms.

13. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms. Upon termination, your right to access StoryKid ceases, but provisions regarding content ownership, limitation of liability, and dispute resolution survive.
